These Terms of Service ("Terms") govern your access to and use of our website, digital products, print-on-demand goods, and creative content services. By accessing or purchasing from us, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Agreement to Terms

By visiting pkranzyhkal.com, browsing our Etsy or Shopify stores, subscribing to our YouTube channel, or purchasing any product, you acknowledge that you have read, understood, and agree to these Terms. These Terms apply to all visitors, users, and customers.

2. Intellectual Property

All content on this website and in our products—including but not limited to designs, graphics, logos, text, images, videos, audio, and software—is the property of PKRANZYHKAL Creative Goods LLC or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any of our materials without prior written permission, except as expressly permitted by a product license.

3. Digital Products

3.1 License

When you purchase a digital product, you receive a non-exclusive, non-transferable license to use the asset according to the specific license terms included with your purchase. Most digital assets include a commercial license allowing use in end products for resale (e.g., printed merchandise, client projects). Extended or enterprise licenses must be purchased separately for high-volume manufacturing.

3.2 Restrictions

You may not:

  • Resell, redistribute, or share the original source files as-is or in competing marketplaces.
  • Use our assets in ways that are defamatory, obscene, illegal, or promote hate speech.
  • Attempt to extract or reverse-engineer source files from compiled or flattened outputs.
  • Claim ownership of the original designs or register them as trademarks without a full rights transfer agreement.

3.3 Refunds

Due to the intangible nature of digital goods, all sales are final once files have been downloaded. We will provide replacements or store credit only if files are corrupted or technically defective upon download. Contact us within 7 days of purchase with your order details.

4. Print-on-Demand (POD) Physical Products

4.1 Production & Shipping

POD items are produced individually after your order is placed. Production typically takes 2-5 business days. Shipping times vary by destination and carrier. Estimated delivery windows are provided on product pages but are not guaranteed.

4.2 Returns & Exchanges

POD items may be returned within 14 days of delivery only if they arrive defective, damaged, or misprinted. We require photographic evidence of the defect. Because items are custom-made per order, we do not accept returns for:

  • Buyer's remorse or change of mind.
  • Incorrect size or color ordered by the customer.
  • Delays caused by shipping carriers or customs.

4.3 International Orders

International customers are responsible for customs duties, import taxes, and brokerage fees. We ship from fulfillment partners located in the US and EU; delivery times to non-US addresses may be longer.

5. Content and Services

Our YouTube channel, blog, newsletters, and other content are provided for informational and entertainment purposes. Opinions expressed are our own. You may share and embed our public content with proper attribution, but you may not scrape, re-upload, or monetize our content on third-party platforms without written permission.

6. Prohibited Activities

You agree not to use our website or services to:

  • Violate any applicable local, state, national, or international law.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Introduce malware, viruses, or other harmful code.
  • Harvest data, use bots, or engage in unauthorized scraping.
  • Interfere with the security or proper functioning of our site.

7. Termination

We reserve the right to terminate or suspend your access to our website and services, without prior notice or liability, for any reason, including breach of these Terms. All provisions which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimer of Warranties

Our website, products, and content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that:

  • Our services will be uninterrupted, secure, or error-free.
  • Any errors in our digital files or content will be corrected.
  • Colors or print results will exactly match screen previews (variations in monitors and printers are normal).

9. Limitation of Liability

To the maximum extent permitted by law, PKRANZYHKAL Creative Goods LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or related to your use of our products or services, even if advised of the possibility of such damages.

Our total liability to you for all claims arising from any single order or interaction shall not exceed the amount you paid for that specific product or service.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Sheridan County, Wyoming, or litigation in the state or federal courts located in Wyoming.

You waive any objection to jurisdiction or venue in such courts. If you are a consumer in the European Union, mandatory consumer protection laws of your country of residence may apply.
